Phase I: Initial Stage and Strategic Planning

  • Support in submitting an initiative for inclusion in the Annual Plan for Construction of Energy Facilities:
    In accordance with the Energy Law, projects with an installed capacity of 1 MW or more must first be included in the Annual Plan adopted by the Government. We guide you through the entire submission process before the competent ministry, ensuring that your application is complete, properly structured, and fully compliant with all statutory requirements, including the objectives set out in the Integrated National Energy and Climate Plan.
  • Site analysis and urban planning review:
    We conduct a detailed legal analysis of the proposed location, verifying its compliance with applicable spatial and urban planning documentation, identifying potential limitations, and determining the most appropriate planning procedure.
  • Determination of land legal status:
    Through review of public records at the Real Estate Cadastre Agency, we verify ownership and legal status of the land. This is particularly critical where projects are planned on agricultural land, which requires additional land conversion procedures.
Phase II: Urban Planning Preparation and Land Conversion

Securing appropriate planning documentation is one of the most complex aspects of energy project development. Our expertise includes providing legal support to the project team in procedures for converting agricultural land into construction land and obtaining spatial planning conditions.

Phase III: Securing Construction Rights and Obtaining Permits

This phase represents the culmination of planning activities and results in obtaining the construction permit.

Our services include legal support throughout the construction permit procedure and legal coordination with the competent authorities at the Ministry of Transport and Communications or the relevant municipality. We manage communication with all involved institutions to obtain the necessary opinions and approvals (e.g., from infrastructure network operators).

Phase IV: Grid Connection

Successful grid connection is a prerequisite for the commercial operation of the power plant. Our support at this stage includes:

  • Representation before the transmission or distribution system operator (MEPSO / EVN):
    • Establishing the legal framework for the preparation of the grid connection study, defining the technical conditions and connection possibilities for your facility.
    • Following completion of the study, finalizing the legal aspects for obtaining the final Grid Connection Decision and concluding the Grid Connection Agreement, defining all rights and obligations between you and the system operator, including connection fees.
Phase V: Licensing and Participation in the Electricity Market

Commencing operations and selling electricity requires appropriate licenses and a thorough understanding of market rules. We provide:

  • Advisory services on regulatory compliance:
    Guidance on all ongoing regulatory obligations, including the mandatory installation of electricity storage systems for variable renewable energy sources, in accordance with the latest amendments to the Energy Law.
  • Legal support for market participation:
    Comprehensive legal advice regarding participation in the electricity market, whether through bilateral power purchase agreements or trading on the organized electricity market (exchange), as well as compliance with balancing responsibility obligations.
